General
1. Information on how to enter and prizes form part of the Terms and Conditions of Entry. Entry into this promotion is deemed acceptance of these Terms and Conditions.
2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this promotion, these Terms and Conditions prevail.
Who Can Enter
3. Subject to the clauses below, entry is open to New Zealand property owners in any provincial locations Property Brokers operates in: https://www.propertybrokers.co.nz/contact who have fulfilled the requirements set out below ('Eligible Entrants'). Eligible Entrants must book a free property appraisal and have an onsite appraisal with Property Brokers within the campaign period.
4. The Promoter is Property Brokers Limited (the 'Promoter'). The Promoter's head office address is 240 Broadway Avenue, Palmerston North Central, Palmerston North.
5. Employees of the Promoter are not eligible to enter the Prize Draw.
How to Enter
6. To enter, Eligible Entrants must, during the Promotional Period (defined below): Book a free property appraisal in a provincial location where Property Brokers operates.
7. A valid entry requires individuals to have an appraisal conducted on their property with Property Brokers before the 12th of November 2023. Any appraisal that has been cancelled or suspended will be considered an ineligible entry into the Prize Draw.
8. The Promoter reserves the right to re-draw a prize if a winner cannot be contacted within five business days. The judges' decision is final, and no correspondence will be entered into with any Entrants or any other person.
9. The Promoter reserves the right to extend, amend, suspend or terminate this offer and these terms and conditions at any time without notice.
10. If the Prize becomes unavailable for any reason, the Promoter may substitute an alternative equivalent prize without notice.
11. The Promoter is not liable for any failure (for whatever reason) to record an entry into the Prize Draw.
12. Any decisions made by the Promoter in relation to the Prize Draw are final, and no correspondence will be entered into.
13. Entry into the Prize Draw is deemed acceptance of these terms and conditions.
Number of Entries Permitted
14. One entry per property appraisal per Eligible Entrant. If a property is listed for sale within the Promotional Period then the Eligible Entrant will receive an additional entry. If the property then sells by going unconditional within the campaign period the Eligible Entrant will receive another entry.
Open, Close, Draw and Publish Dates
15. The promotion commences on Sunday the 1st of October 2023 and concludes on Sunday the 12th of November 2023 at 11:59am (AEDT) ('Promotional Period'). All times noted in these Terms and Conditions are local times, based on the location of the Promoter. Entries must be received by the Promoter prior to the promotion close date and time.
16. The Winner will be the first valid entry selected by a random draw at the Promoter's Premises at 240 Broadway, Palmerston North Central, Palmerston North on Thursday the 16th of November 2023. The Winner will be notified by email or phone by the 17th of November 2023. Arrangements will be made for the Winner to be presented the prize. If the Winner is not able to be present, a proxy can be appointed.
17. The Promoter will ensure that all entries have an equal chance of winning a prize.
Prize on Offer
18. The total prize pool is valued at NZ$25,000 (Including GST).
19. The total number of promotion winners in this promotion is two grand prize winners of NZ$10,000 each and 10 x NZ$500 spot prizes. One $10,000 prize will go to the Otago and Southland area. The remaining $10,000 main prize will be available to the rest of Property Brokers areas across New Zealand. The spot prizes will be drawn at random throughout the campaign period and will be available across New Zealand.
20. Acceptance of the Prize is deemed consent for the Promoter to use the Winner's details for promotional and media purposes.
Further Terms and Conditions
21. The Promoter reserves the right to disqualify any Entrant who provides false information or who seeks to gain an unfair advantage or to manipulate this promotion.
Privacy Collection Statement
22. The Promoter and its related entities collect Entrants' personal information for the purpose of conducting this promotion (including but not limited to determining and notifying Winners).
Copyright, Statutory Guarantees, Waiver, and Liability
23. All entries and any copyright subsisting in the entries become and remain the property of the Promoter, who may publish or cause to be published any of the entries received.
24. In participating in the promotion, the Winner agrees to participate and cooperate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The Winner (and their companion) agrees to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media, including online social networking sites, and the Winner (and their companion) will not be entitled to any fee for such use.
25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any theft, unauthorised access or third party interference; (b) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (c) any variation in prize value to that stated in these Terms and Conditions; (d) any tax implication incurred by a Winner or Entrant.
