Property Brokers Limited (“PB”, “we”, “us”, “our”) with registered offices at 240 Broadway Avenue, Palmerston North is committed to protecting your privacy when dealing with personal information. Personal information is information about an identifiable individual (a natural person).

Collection of Personal Information

We collect personal information when you interact with us, use our services, visit our websites, attend property inspections or events, make enquiries, apply for tenancy, or engage us in relation to property services.

The personal information we collect may include

Where you apply for a tenancy, we collect, use, and disclose personal information to assess your application. This may include your identity and contact details, employment and income information, references, and previous tenancy history.

We will only request information that is reasonably necessary to assess your application, consistent with the Privacy Act 2020 and guidance issued by the Office of the Privacy Commissioner on information sought from prospective tenants.

Where practicable, we collect personal information directly from you.

Where we collect your personal information from someone other than you (for example, from the third parties listed below), we will take reasonable steps to ensure you are made aware of that collection and of the related matters set out in the Privacy Act 2020, unless an exception under the Act applies.

In some circumstances, we may also collect personal information from third parties including:

  • landlords, vendors, purchasers, tenants, or applicants
  • referees
  • publicly available sources
  • credit reporting agencies
  • government agencies
  • real estate or property-related platforms
  • social media or advertising platforms
  • third-party service providers
  • other persons authorised by you or permitted by law.

Purpose of Collection

We collect, use, and disclose personal information to provide our real estate and property management services, communicate with you, verify identity, comply with legal obligations, process payments, manage tenancy and property matters, market our services and properties, improve our systems and services, and protect our legal rights and interests.

As a real estate agency, we are a reporting entity under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009, and we collect and verify identity information (which may include identity documents) to meet our obligations under that Act.

If you do not provide requested information, we may be unable to provide some or all of our services.


Disclosure of Personal Information

We may disclose personal information where reasonably necessary to:

  • our employees, agents, contractors, and related offices
  • landlords, vendors, purchasers, tenants, and service providers
  • professional advisers, tradespeople, and financial institutions
  • technology, marketing, and software providers
  • third-party property listing platforms and portals, for the purpose of publishing and marketing property listings
  • real estate industry bodies, such as the Real Estate Institute of New Zealand (REINZ)
  • government agencies, regulators, or law enforcement agencies where required or permitted by law
  • other persons authorised by you or permitted by law.

We take reasonable steps to ensure that third parties who receive personal information from us are subject to appropriate privacy and confidentiality obligations. Some third-party service providers process personal information only on our behalf and on our instructions, and we treat their handling of that information as our own.

Where we disclose personal information to a third party for that party's own independent purposes, that party may have its own obligations under the Privacy Act 2020, and its own privacy policy will apply.


If You Are Selling or Listing a Property With Us

If you list a property for sale or lease with us, we collect and disclose personal information and property information to market your property and complete the transaction.

We may disclose this information to prospective purchasers or tenants and their advisers, to third-party listing and property platforms, and to the Real Estate Institute of New Zealand (REINZ) and other real estate industry bodies.

Some recipients act on our behalf and use the information only for our purposes; others, including listing platforms and industry bodies, are independent and may use the information for their own purposes, such as compiling property records and market statistics.

These disclosures are also addressed in your agency or listing agreement with us, and we will take reasonable steps to make you aware of them.


Overseas Disclosure and Storage

Some of our third-party service providers may store or process personal information outside New Zealand, including cloud-based technology and software providers.

Where personal information is disclosed overseas, we take reasonable steps to ensure the recipient protects the information in a manner that provides comparable safeguards to those required under the Privacy Act 2020.


Digital Advertising, Analytics, and Cookies

We may use cookies, analytics tools, and third-party advertising services, including Google and Meta (Facebook), to improve our websites, services, and advertising effectiveness.

These technologies may collect information about your interactions with our websites and advertisements.

We will generally respond to requests within 20 working days, unless an extension is permitted under the Privacy Act 2020.

If you request deletion of personal information, we will consider the request in accordance with applicable legal and regulatory obligations. Certain information may need to be retained for lawful business or compliance purposes.

We may charge reasonable costs permitted under the Privacy Act 2020 for providing copies of personal information.


Privacy Breaches

We take privacy breaches seriously and maintain processes for identifying, assessing, and responding to suspected privacy incidents.

Where a privacy breach has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and affected individuals in accordance with the Privacy Act 2020.


Internet Use and Third-Party Websites

While we take reasonable steps to maintain secure internet systems, no method of internet transmission is completely secure.

Our websites may contain links to third-party websites or services which operate independently from us and may have their own privacy policies.
